A 23-year-old man has been found guilty of secretly taking photos up under the skirt of an unsuspecting woman.

A 23-year-old man has been found guilty of secretly taking photos up under the skirt of an unsuspecting woman.

Harshit Garcha was charged with five counts of secretly observing or recording for a sexual purpose, but was only found guilty at Richmond Provincial Court on Thursday on one charge.

Before the trial kicked off, defense counsel Gary Adams argued that no crime had been committed, because the incident took place in a public area, where theres a certain forfeiture of privacy.

Crown counsel Brian MacFarlane disagreed, saying everyone has a reasonable right to privacy even in a public setting.

Garcha used a digital camera to record a womans private area, MacFarlane said, adding it didnt matter if they were out in public or not. But without her permission, that was illegal.

The court ruled in MacFarlanes favour and Garcha was found guilty on one charge.

Garcha is expected back on Oct. 18 for a pre-sentence hearing.
