Man who assaulted ex loses appeal

A man who terrorized and assaulted his wife over her infidelity, including an attack with a baseball bat while she and her new partner were sleeping, has lost his sentence appeal.

A man who terrorized and assaulted his wife over her infidelity, including an attack with a baseball bat while she and her new partner were sleeping, has lost his sentence appeal.

Bruce William MacDonald pleaded guilty to 12 offences against his estranged wife, Farah Dubash and Karl Zeeso, her new partner.

The crimes began in September 2010, when MacDonald suspected his wife was having an affair and uttered several death threats against her.

"If you ever leave me for this guy I will just kill him. He'll be dead," he told her at one point.

MacDonald, who told his wife he had connections with the Hells Angels, also threatened to kill Zeeso if he continued to see his wife.

When she learned of the threats to Zeeso, Dubash told MacDonald she was leaving him. He responded by throwing her onto the bed, punching her in the head and choking her to the point of unconsciousness.

He was arrested and charged with assault and uttering threats, but was released on condition he have no contact with her and not attend her new residence in Richmond.

But he violated that court order when he uttered further threats and was re-arrested but then released with another no- contact order.

MacDonald breached the court order a second time when he went to Dubash's apartment, scaled all six balconies of the building to reach her suite and beat Dubash and Zeeso as they were sleeping.

MacDonald, 57 at the time of the offences, received a sentence of 5 ½ years in prison.

On appeal, he argued that the judge erred in that his sentence was not similar to other sentences imposed on similar offenders and that it was disproportionate and demonstrably unfit.

But a three-member panel of the B.C. Court of Appeal has dismissed his appeal.
