Lawsuit dismissed for Richmond restaurant suing for flood damages

The Keg in Ironwood claimed contractors caused a flood, causing a shutdown of business.

The Keg Steakhouse & Bar in the Ironwood neighbourhood has resolved a lawsuit about flood damages.

A Richmond restaurant and its contractor have agreed to put an end to a lawsuit that began in 2022.

Keg Restaurants Ltd. and Steveston Restaurants Ltd., which operate the Keg Steakhouse & Bar in Ironwood, filed a lawsuit in the B.C. Supreme Court claiming Suncoast Enclosures flooded its property while installing a patio.

According to the lawsuit filed in September 2022 and amended in 2023, the Keg claimed Suncoast had "drilled into the concrete and punctured the main sanitary line" at the property in late 2021.

The restaurant was forced to close for repairs, causing business losses and costs for repairs, the Keg claimed in its lawsuit, and blamed Suncoast for negligence.

Suncoast denied the allegations in a response filed in December 2022, including denying the Keg's claim they entered into a contract to install a patio at the Keg.

A third party, All Hands on Deck Construction Ltd., was subsequently added to the lawsuit at the beginning of 2023 by Suncoast, with a claim this contractor was responsible for the piling installation work.

If the incident did happen, claimed Suncoast in the Third Party Notice, it was caused by All Hands' negligence.

All Hands denied liability in a response filed in March 2023 and said Suncoast and the Keg expressly said "there were no underground utilities in the location where the piles were installed."

Court records show an application was made on Nov. 30, 2023 for a consent order to end the lawsuit.

The consent order was issued by the B.C. Supreme Court on Jan. 4.

According to the order, all claims, including those against All Hands, were dismissed without cost to any party. The order has the same force and effect as if it were a judgment pronounced after a trial.
